A request has been made to remove restrictions on development, including subdividing, in the Wisteria Development area. We want to know if you want to see these restrictions removed, as it could impact future development around your property.

Background

In 1999, the Resource Planning and Development Commission (now called the Tasmanian Planning Commission) approved a planning scheme amendment and subdivision application for 31 lots at 11A Wisteria Avenue, Cremorne. A condition of the subdivision permit required that, in accordance with Section 71 of the Land Use Planning and Approvals Act 1993 (Tas.), all subdivided lots were subject to the Wisteria Development Plan and an agreement to this effect was to be registered on all relevant Certificate of Titles.

In approving the subdivision, the Commission determined that no further subdivision of the lots should occur to minimise environmental impact on the Pipe Clay Lagoon catchment because of overland flow, wastewater management and inundation risks. The Wisteria Development imposes development provisions on future development on the lots, additional to those under the Tasmanian Planning Scheme – Clarence, including restricting further subdivision.

The Wisteria Development Plan affects the lots shown in Figure 1 and listed under "Affected properties".

The Council, in its role as a Planning Authority, has received a request to end the agreement and to enable a subdivision application to progress which, currently, is contrary to the Wisteria Development Plan.

Section 74(3) of the Land Use Planning and Approvals Act 1993 (Tas.) provides the power for the Planning Authority to end an agreement with:

  • the consent of all persons who are bound by it; or
  • approval by the Tasmanian Planning Commission.

We are seeking the opinions of those affected by the agreement, as well as the wider community, to inform the Council’s position on this matter. If supported, the matter will be to be put forward to the Tasmanian Planning Commission, who are responsible for determining the appropriateness of ending the agreement.
